[Ceramic Dental Clinic Online Membership Terms] These Terms are intended to set forth and ensure compliance, as prescribed by the Telecommunications Business Act and its Enforcement Decree, with matters concerning the conditions and procedures for using the services provided by Ceramic Dental Clinic (hereinafter "the Company") and other necessary matters. Article 1 (Purpose, etc.) ① The purpose of the Ceramic Dental Clinic (http://www.ceramicdental.co.kr) User Terms (hereinafter "these Terms") is to set forth the rights, obligations and responsibilities of members and Ceramic Dental Clinic in using the Internet-related services provided by Ceramic Dental Clinic (hereinafter "the Services"). ② A person who wishes to become a member shall be deemed to have agreed to these Terms upon completing the procedures prescribed by Ceramic Dental Clinic and clicking the "Register" button. Matters concerning the rights, obligations and responsibilities of members and Ceramic Dental Clinic not set forth in these Terms shall be governed by the Telecommunications Business Act, other relevant laws of the Republic of Korea, and commercial customs. Article 2 (Definition of Member) "Member" means a person who accesses Ceramic Dental Clinic, registers as an online member of Ceramic Dental Clinic in accordance with these Terms, and receives the Services provided by Ceramic Dental Clinic. Article 3 (Membership Registration) ① A person who wishes to become a member applies for membership by entering member information in the registration form prescribed by Ceramic Dental Clinic and clicking the "Register" button. ② Ceramic Dental Clinic shall register as a member any person who has applied for membership as described in Paragraph 1, unless any of the following applies: 1. The applicant has previously lost membership under Article 6, Paragraph 3 of these Terms; provided, however, that an exception is made for a person for whom 3 years have passed since the loss of membership under Article 6, Paragraph 3 and who has obtained Ceramic Dental Clinic's approval for re-registration. 2. The registration contains false information, omissions or errors. 3. Ceramic Dental Clinic otherwise determines that registering the applicant as a member would significantly hinder it technically. ③ The membership agreement is formed at the time Ceramic Dental Clinic's approval reaches the applicant. ④ If any of the member information entered under Paragraph 1 changes, the member shall immediately correct and update it. Article 4 (Provision and Change of Services) ① Ceramic Dental Clinic provides the following Services to members: 1. Ceramic Dental Clinic news mail service 2. Ceramic Dental Clinic online consultation room / appointment service 3. Sections and content services for Ceramic Dental Clinic online members 4. Other services provided by Ceramic Dental Clinic in partnership with other companies ② Ceramic Dental Clinic may change the Services set forth in Paragraph 1 after notifying members of the details of the changed Services and the date of provision in the manner prescribed in Article 7, Paragraph 2. Article 5 (Suspension of Services) ① Ceramic Dental Clinic may temporarily suspend the provision of the Services in the event of maintenance, inspection, replacement or failure of computers or other information and communication equipment, or interruption of communications, and may completely discontinue the Services currently provided due to replacement with new services or other reasons Ceramic Dental Clinic deems appropriate. ② In the event of a suspension of the Services under Paragraph 1, Ceramic Dental Clinic shall notify members in the manner prescribed in Article 7, Paragraph 2; provided, however, that this shall not apply where prior notice is impossible due to a suspension of the Services for reasons beyond Ceramic Dental Clinic's control (such as disk failure or system downtime without intent or negligence on the part of the system administrator). Article 6 (Withdrawal and Loss of Membership, etc.) ① A member may at any time request Ceramic Dental Clinic to cancel the member's registration (withdrawal), and Ceramic Dental Clinic shall, immediately upon receiving such a request, take the procedures to cancel that member's registration. ② If a member falls under any of the following, Ceramic Dental Clinic may restrict, suspend or terminate the member's membership by appropriate means: 1. The member registered false information when applying for membership 2. The member threatens the order of electronic commerce, such as by interfering with another person's use of the Ceramic Dental Clinic site or misappropriating another person's information 3. The member uses Ceramic Dental Clinic to engage in acts prohibited by law or these Terms or contrary to public order and morals ③ If Ceramic Dental Clinic decides to terminate a member's membership, it shall cancel the membership registration. In this case, the member shall be notified before the registration is cancelled and given an opportunity to explain. Article 7 (Notices to Members) ① When Ceramic Dental Clinic gives notice to a specific member, it may do so to the email address registered with Ceramic Dental Clinic. ② When Ceramic Dental Clinic gives notice to members at large, it may replace individual notice by posting the notice on the Ceramic Dental Clinic bulletin board for at least one week. Article 8 (Protection of Members' Personal Information) Ceramic Dental Clinic endeavors to protect members' personal information, including member registration information, in accordance with relevant laws. The protection of members' personal information shall be governed by relevant laws and the "Privacy Policy" established by Ceramic Dental Clinic. Article 9 (Obligations of Ceramic Dental Clinic) ① Ceramic Dental Clinic shall not engage in acts prohibited by law or these Terms or contrary to public order and morals, and shall endeavor to provide the Services continuously and stably as set forth in these Terms. ② Ceramic Dental Clinic shall establish a security system to protect members' personal information (including credit information) so that members can use Internet services safely. ③ Ceramic Dental Clinic shall not send commercial advertising emails that members do not wish to receive. Article 10 (Obligations Regarding Member ID and Password) ① Except where Ceramic Dental Clinic is responsible under relevant laws or the "Privacy Policy", each member is responsible for managing his or her own ID and password. ② A member shall not allow any third party to use his or her ID and password. ③ If a member becomes aware that his or her ID and password have been stolen or are being used by a third party, the member shall immediately notify Ceramic Dental Clinic and follow any instructions given by Ceramic Dental Clinic. Article 11 (Obligations of Members) ① Members shall not engage in any of the following acts: 1. Registering false information when applying for membership or making changes 2. Altering information posted on Ceramic Dental Clinic 3. Infringing the personal rights or intellectual property rights of Ceramic Dental Clinic or any third party, or interfering with their business 4. Misappropriating another member's ID 5. Sending junk mail, spam mail, chain letters, emails soliciting participation in pyramid schemes, or emails containing obscene or violent messages, images, audio, etc., or otherwise disclosing or posting information contrary to public order and morals 6. Transmitting or posting information (such as computer programs) whose transmission or posting is prohibited by relevant laws 7. Posting content or sending emails while impersonating or posing as an employee of Ceramic Dental Clinic or an administrator of Ceramic Dental Clinic's Internet services, or by misappropriating another person's name 8. Posting or emailing material containing software viruses or any other computer code, files or programs designed to disrupt or destroy the normal operation of computer software, hardware or telecommunications equipment 9. Harassing other members, such as by stalking 10. Collecting, storing or disclosing personal information about other members without their consent 11. Engaging in for-profit activities using Ceramic Dental Clinic's Services, such as posting advertisements or promotions targeting the general public or sending spam mail 12. Violating the terms set forth for the Services provided by Ceramic Dental Clinic or other rules regarding the use of the Services ② If a member engages in any act under Paragraph 1, Ceramic Dental Clinic may restrict, suspend or terminate the member's membership by appropriate means as set forth in Article 6, Paragraphs 2 and 3 of these Terms. ③ A member is liable to compensate for any damage suffered by Ceramic Dental Clinic or other members due to causes attributable to that member. Article 12 (Deletion of Public Posts) If the content of a member's public post falls under any of the following, Ceramic Dental Clinic may delete the public post without prior notice to the member and may restrict, suspend or terminate that member's membership: 1. Content that slanders other members or third parties or damages their reputation through defamation 2. Content that disseminates information, text, graphics, etc. contrary to public order and morals 3. Content deemed to be related to criminal acts 4. Content that infringes the copyright or other rights of other members or third parties 5. Content with a conspicuous advertising or commercial purpose 6. Other content deemed to violate relevant laws Article 13 (Ownership of Copyright and Restrictions on Use) ① Copyright and other intellectual property rights in works created by Ceramic Dental Clinic belong to Ceramic Dental Clinic. ② Members shall not use, or allow third parties to use, information obtained through Ceramic Dental Clinic for commercial purposes by reproduction, transmission, publication, distribution, broadcasting or other means without the prior consent of Ceramic Dental Clinic. Article 14 (Provisions on Consultations) ① The content of consultations conducted through the Services may, after personal identifying information is deleted, be used for the following purposes: 1) Academic activities 2) Medical practice 3) Medical services 4) Authoring activities such as printed materials and CD-ROMs 5) Part of service content such as FAQs and recommended consultations ② The consultation service may be withheld in whole or in part in the case of the following consultation requests: 1) Repeated requests for consultation on the same matter 2) Requests using expressions contrary to common sense or vulgar language 3) Requests demanding a diagnosis 4) Requests regarding treatment costs, examination costs, drug prices, drug efficacy, etc. 5) Consultations for the purpose of obtaining information to harm others Article 15 (Amendment of Terms) ① Ceramic Dental Clinic may amend these Terms to the extent that doing so does not violate relevant laws such as the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Commerce, the Digital Signature Act, and the Act on Promotion of Information and Communications Network Utilization. ② When Ceramic Dental Clinic amends these Terms, it shall specify the effective date and the reasons for the amendment and post them together with the current Terms on the initial screen from 7 days before the effective date until the day before the effective date. ③ When Ceramic Dental Clinic amends these Terms, the amended Terms shall also apply to members who registered before the amendment, unless the amended content violates relevant laws. ④ A member who objects to the amended Terms may withdraw in accordance with Article 6, Paragraph 1. Article 16 (Jurisdiction) Any lawsuit arising from a dispute between Ceramic Dental Clinic and a member regarding the use of the Services shall be filed with a court of the Republic of Korea having jurisdiction under the Civil Procedure Act. Addendum These Terms shall apply from June 27, 2017 until new Terms are issued.
